1. Agreement to these terms
These Terms of Service ("Terms") are a legal agreement between you and Moon Shard Ltd ("Micro", "we", "us") governing your use of the Micro mobile application and related services (the "Service"). By downloading or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 17 years old, or the age of majority where you live, and able to form a binding contract, to use the Service.
3. What Micro does — and what it does not promise
Micro analyzes short-form videos and produces scores, findings, suggested fixes, and view or growth estimates. These outputs are informational and predictive only. Estimates and projections are framed against your own history and follower range where possible and are not guarantees. We do not promise any particular number of views, followers, engagement, revenue, or "going viral". Results depend on many factors outside our control, including your content and each platform's algorithms. Any figures shown in marketing (for example, typical improvements creators report) are illustrative and not a promise of your results.
4. Your content
You keep all rights to the videos and other content you analyze ("Your Content"). You represent that you own or have the rights to submit Your Content and that analyzing it does not violate anyone's rights or any platform's terms. You grant us a limited, revocable licence to process Your Content solely to provide the analysis you request — including uploading the specific video you choose to our analysis service and to Google's Gemini API as described in our Privacy Policy. We do not claim ownership of Your Content and do not use it to train models.
5. Subscriptions, billing, and cancellation
- Some features require a paid subscription, offered as a weekly or yearly plan. There is no free trial — both plans begin billing immediately at confirmation of purchase.
- Subscriptions are sold through the Apple App Store. Payment is charged to your Apple Account at confirmation of purchase.
- Subscriptions auto-renew at the then-current price unless cancelled at least 24 hours before the end of the current period. Your Apple Account is charged for renewal within 24 hours before the period ends.
- You manage or cancel your subscription in your device's Settings → your Apple Account → Subscriptions. Deleting the app does not cancel a subscription.
- Except where required by law, payments are non-refundable; refunds are handled by Apple under Apple's policies.
- Current prices are shown in the app before you purchase and may change with notice as permitted by the App Store.
6. Acceptable use and fair-use limits
You agree not to misuse the Service, including by: submitting content you do not have the right to submit; attempting to reverse engineer, disrupt, or overload the Service; circumventing usage or security controls; or using the Service to break the law or a third party's rights or platform rules.
To keep the Service available for everyone, cloud analyses are subject to fair-use limits. Currently, analyses are limited to 50 per day per user (measured per network address). We may adjust these limits, and may throttle, suspend, or decline requests that exceed them or that appear automated or abusive.
7. Intellectual property
The Service, including its software, design, the Micro name, and the Micro vortex mark, is owned by Moon Shard Ltd and protected by law. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the Service for your own creative work. You may not copy, resell, or create derivative works from the Service except as allowed by law.
8. Third-party services
The Service relies on third parties including Apple, Google, and Cloudflare. Your use may also be subject to their terms. We are not responsible for third-party services, and the platforms you create for (such as TikTok, Instagram, or YouTube) are independent of Micro and not affiliated with or endorsing us.
9. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any analysis or estimate is accurate or will improve your results.
10. Limitation of liability
To the fullest extent permitted by law, Moon Shard Ltd will not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for lost profits, views, followers, or revenue, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the 12 months before the claim or USD $50. Nothing in these Terms limits liability that cannot be limited by law.
11. Termination
You may stop using the Service at any time. We may suspend or end your access if you breach these Terms or to protect the Service. Sections that by their nature should survive (such as content licence limits, disclaimers, and liability limits) survive termination.
12. Changes
We may update these Terms as the Service evolves. If we make material changes we will update the date above and, where appropriate, notify you in the app. Continued use after changes take effect means you accept them.
13. Governing law
These Terms are governed by the laws of England and Wales, without regard to conflict-of-laws rules, and, where you are a consumer, without depriving you of the mandatory protections of your local law.
14. Apple App Store terms
These Terms are between you and Moon Shard Ltd only, not Apple, and Apple is not responsible for the Service or its content. Apple has no obligation to provide maintenance or support for the Service. To the extent permitted by law, Apple has no warranty obligation, and any claims relating to the app's failure to conform to a warranty are our responsibility. Apple is not responsible for addressing your or any third party's claims relating to the app, including product-liability, legal or regulatory, and intellectual-property claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You confirm you are not located in a country subject to a U.S. Government embargo or designated as "terrorist supporting", and are not on any U.S. Government prohibited-parties list.
